In this 1896 case homer please argued his right to "equal protection of the laws". The court argued segregation was legal as long as those separate facilities were provided for blacks, were equal to those provided to whites. Even though there was a "separate but equal" ruling, rarely ever, if at all, were African American schools and facilities made equal.
