Five month before the 1972 election for president, an alert security guard found burglars in the Democratic Party headquarters. President Nixon was suspected for this. Although he refuse he had never did it, they found audiotapes of the President discussing the break-in with its organizers. He claimed that a President had the right to privileged communication that could not be looked at by any other branch of the government. The case was quickly sent to the Supreme Court.
