Gibbons:

Ogden:

Supplied to Constitution:

The court decision made in the Gibbons vs Ogden came from the preamble idea of the Constitution being the supreme power of the land by stating in Article 1 Section 8, Commerce Clause: "To regulate Commerce with foreign Nations, and among the several States, and with the Indian Tribes." The case dealt with interstate commerce. Aaron Ogden filed a suit agains Thomas Gibbons, saying he didn't have the right to operate on New York waters. Ogden's lawyer used the Commerce Clause from the Constitution. Constitutional Supremacy overpowers interstate commerce laws.

Thomas Gibbons lawyer said that the New York state laws allowed him to operate his ship
