This Amendment was ratified on December 15, 1791. The Fifth Amendment is based on legal rights. It lists five important rights of citizens involved with the justice system. First, it gives people who are accused of a crime the right to a grand jury hearing.
Second, the amendment ensures that a person who goes to trial and not found guilty can not be tried again for the same crime.
Third, it prohibits self-incrimination which means that police can not force people to say things that might be used against them in trial. Today, before policemen can arrest, they have to state the "Miranda warning" to the victim. The "Miranda warning" is a reminder to the person being arrested, that he/she has the right to remain silent.
V Amendment
Next, this Amendment says that a person cannot be deprived from "life, liberty, or property, without due process of law." This means that government must follow clear rules and act responsibly when carrying out the law.
Finally, the Fifth Amendment states that the government cannot take someone's private property for public use without paying a fair price.
