Engel v. Vitale (1962)

• The law was ruled unconstitutional because it violated the Establishment Clause of the First Amendment.

• Even though the bill of rights applies to the central government, the Due Process Clause extends these responsibilities to the States.

• The Due Process Clause means that all levels of American Government must operate within the law and provide fair procedures.

• “If a Bill of Rights guarantee is incorporated in the “due process” requirement of the Fourteenth Amendment, state and federal obligations are exactly the same” -Peter Strauss.
