Unfair dismissal
A worker has the right to dismiss or terminate an employee, if they have grounds to do so. If there are no grounds, the now terminated employee has a right to file either an unlawful dismissal or an unfair dismissal claim. The unlawful dismissal is when dismissal is against law, meaning if they are dismissed due to; race, sex, sexuality, age, disability, marital status, family responsibilities, pregnancy, religious or political beliefs, whether they are with or not with a trade union, temporary absence due to illness or injury, a complaint being filed against the employer among other things. If the unlawful dismissal claim is rejected or there is no grounds for that particular claim, the employee may file for an unfair dismissal application. Unfair dismissal is when there is no fair reason, and considers all the circumstances such as, if the employer hasn't given a chance to respond, no reason at given for dismissal, if there was warnings.
